Court mulls revealing secret government plan to cut cell phone service

Feds: SOP 303 mobile-phone kill-switch policy would endanger public if disclosed.

A federal appeals court is asking the Obama administration to explain why the government should be allowed to keep secret its plan to shutter mobile phone service during “critical emergencies.”

The Department of Homeland Security came up with the plan—known as Standing Operating Procedure 303—after cellular phones were used to detonate explosives targeting a London public transportation system.

SOP 303 is a powerful tool in the digital age, and it spells out a “unified voluntary process for the orderly shut-down and restoration of wireless services during critical emergencies such as the threat of radio-activated improvised explosive devices.”

The US Court of Appeals for the District of Columbia Circuit in February sided (PDF) with the government and ruled that the policy did not need to be disclosed under a Freedom of Information Act request from the Electronic Privacy Information Center. The court agreed with the government’s citation of a FOIA exemption that precludes disclosure if doing so “could reasonably be expected to endanger the life or physical safety of any individual.”

EPIC asked the court to revisit its ruling, arguing that the decision, “if left in place, would create an untethered ‘national security’ exemption'” in FOIA law. On Friday, the court ordered (PDF) the government to respond—a move that suggests the appellate court might rehear the case.

EPIC originally asked for the document in 2011 in the wake of the shut down of mobile phone service in the San Francisco Bay Area subway system during a protest. The government withheld the information, EPIC sued and won, but the government then appealed and prevailed.

In its petition for rehearing, EPIC argued that the appellate court’s decision “created a catch-all provision that would allow federal agencies to routinely withhold records subject to disclosure where the agency merely asserts a speculative security risk.”

Under the direction of the so-called National Security Telecommunications Advisory Committee, SOP 303 allows for the shutting down of wireless networks “within a localized area, such as a tunnel or bridge, and within an entire metropolitan area.”

There have been no publicly disclosed instances when SOP 303 has been invoked, but the telecoms have agreed to shutter service when SOP 303 is invoked.

Local governments, however, have the power to shutter wireless service regardless of SOP 303.

The last known time mobile phone service was cut by a government agency was the San Francisco example from 2011. That’s when the Bay Area Rapid Transit System took heat for disabling service to quell a protest in four downtown San Francisco stations. The three-hour outage was done after BART cut service without the assistance of the telcos.

In the aftermath, BART produced a new policy that said service could only be cut off when “there is strong evidence of imminent unlawful activity that threatens the safety of district passengers, employees, and other members of the public.”

Police agencies in Broward County are assisting members of the U.S. Special Operations Forces who are undergoing urban warfare training.

The exercises began Monday, will last until March 27 and will be held at locations that the military will not disclose.

U.S. Special Operations is commanded out of Tampa and has staged such “routine drills” in cities throughout the country, a spokesman said.

The 200 military personnel are from the four branches: Air Force, Army, Marines and Navy.

The goal is to prepare participants in realistic, unfamiliar training conditions before they deploy for combat overseas. Those urban locations can’t be replicated on a practice range, the military said.

The exercises will happen in a variety of places but will not be held at the beaches, the Everglades, malls or large population centers, the spokesman said.

Local police departments are tasked with managing traffic and keeping spectators away.

Seven Southwestern states will soon be infiltrated by 1,200 military special ops personnel as part of a controversial domestic military training in which some of the elite soldiers will operate undetected among civilians.

Operation Jade Helm begins in July and will last for eight weeks. Soldiers will operate in and around towns in Texas, New Mexico, Arizona, California, Nevada, Utah and Colorado where some of them wil drop from planes while carrying weapons loaded with blanks in what military officials have dubbed Realistic Military Training.

But with residents of the entire states of Texas and Utah dubbed ‘hostile’ for the purposes of the exercises, Jade Helm has some concerned the drills are too realistic.

Headlines like Freedom Outpost‘s ‘Operation Jade Helm—military trains for martial law in American South-west’ abound across the Right-leaning blogosphere and Info Wars warns that Jade Helm is simply ‘an effort to test the effectiveness of infiltration techniques’ on the American public.

‘They’re having Delta Force, Navy SEALS with the Army trained to basically take over,’ Info Wars’ Alex Jones said Sunday. ‘Texas is listed as a hostile sector, and of course, we are…We’re here defending the republic.’

The Houston Chronicle reports that, among the planned exercises, soldiers will attempt to operate undetected among civilian populations.

Residents, in turn, will be asked to report suspicious activity in order to gauge the effectiveness of the soldiers.

Military officials say they’ve gotten the go ahead for the operations from local authorities such as mayors and county commissions.

And sheriff’s deputies told the Houston Chronicle they would ensure residents living near where aircraft were slated to create disturbances and drop soldiers, civilian and military vehicles will barrel through and where blank rounds would be fired.

Jim Stewart with the Brazos County, Texas Sheriff’s Office told the Chronicle that such exercises are far from anything new.

‘Special ops for years have trained off-post for years, where they go out and have folks that are role players out on the economy,’ said the Army intelligence veteran. ‘They’ll have a scenario they’ll be following and they’ll interact with these role players as if they’re in another country.’

However, the U.S. Army Special Operations Command themselves say Jade Helm is different.

‘The size and scope of Jade Helm sets this one apart. To stay ahead of the environmental challenges faced overseas, Jade Helm will take place across seven states,’ the USASOC wrote in a March 24 release.

‘The diverse terrain in these states replicates areas Special Operations Soldiers regularly find themselves operating in overseas.’

The military has also reacted to widespread fear of the operation by calling some ultra-conservative coverage of the ‘martial law’ drills alarmist and inaccurate.

‘That notion was proposed by a few individuals who are unfamiliar with how and why USASOC conducts training exercises,’ USASOC spokesman Army Lt. Col. Mark Lastoria told Stripes.

‘This exercise is routine training to maintain a high level of readiness for Army Special Operations Forces because they must be ready to support potential missions anywhere in the world on a moment’s notice.’

WASHINGTON — U.S. Army Special Operations Command is pushing back against alarmist claims that an upcoming U.S. military exercise is a preparation for imposing martial law or subduing right-leaning groups and individuals.

Conspiracy theories about the exercise, known as JADE HELM 15, appeared online this week. Some commentators railing against the event referred to an online slide show allegedly created by USASOC, which outlined a special operations exercise slated to take place across multiple states, outside the confines of U.S. military bases. In the slide show, a map of the southwest region of the United States labels Texas and other territory as “hostile” or “insurgent pocket.” The document also refers to coordination with law enforcement agencies.

Officials at USASOCM were not able to immediately verify the authenticity of the slide show because their computer firewalls prevented them from accessing the websites where the document appeared.

Army Lt. Col. Mark Lastoria, a USASOC spokesman, confirmed that there is an upcoming exercise called Jade Helm 15 which is scheduled to take place this summer at locations in Texas, Arizona, New Mexico, Utah, Colorado, California and Nevada. But he denied the event is preparation for some sort of military takeover.

“That notion was proposed by a few individuals who are unfamiliar with how and why USASOC conducts training exercises,” he said in an email. “This exercise is routine training to maintain a high level of readiness for Army Special Operations Forces because they must be ready to support potential missions anywhere in the world on a moment’s notice.”

He said the only thing unique about this particular exercise, which is slated to take place between July 15 and Sept. 15, is “the use of new challenging terrain” which was chosen because it is similar to conditions special operations forces operate in overseas.

Lastoria said coordination with local law enforcement is necessary for safety reasons because some of the training will take place outside of military bases where civilian agencies have jurisdiction.

He said his office has been receiving a lot of calls from people who heard about the exercise and are concerned about “the nature of the training objectives.”

Why would the government want to punish people that are just trying to work hard, become more self-sufficient and take care of their families?

There are approximately 3 million preppers in the United States today, and often they appear to be singled out for punishment by bureaucratic control freaks that are horrified at the thought that there are families out there that actually want to try to become less dependent on the system.

So if you use alternative methods to heat your home, or if you are not connected to the utility grid, or if you collect rainwater on your property, or if you believe that parents should have the ultimate say when it comes to health decisions for their children, you could become a target for overzealous government enforcers.

Once upon a time, America was the land of the free and the home of the brave, but now we are being transformed into a socialist police state where control freak bureaucrats use millions of laws, rules and regulations to crack down on anyone that dares to think for themselves.

For example, people have been burning wood to heat their homes since this country began. And this is still very common in rural areas. But the Obama administration does not like this at all. The Obama bureaucrats at the EPA fear that our little wood stoves may be contributing to “global warming”, so they have outlawed the production and sale of 80 percent of the wood stoves that are currently in use. The following comes from a recent Forbes article…

It seems that even wood isn’t green or renewable enough anymore. The EPA has recently banned the production and sale of 80 percent of America’s current wood-burning stoves, the oldest heating method known to mankind and mainstay of rural homes and many of our nation’s poorest residents. The agency’s stringent one-size-fits-all rules apply equally to heavily air-polluted cities and far cleaner plus typically colder off-grid wilderness areas such as large regions of Alaska and the American West.

While EPA’s most recent regulations aren’t altogether new, their impacts will nonetheless be severe. Whereas restrictions had previously banned wood-burning stoves that didn’t limit fine airborne particulate emissions to 15 micrograms per cubic meter of air, the change will impose a maximum 12 microgram limit. To put this amount in context, EPA estimates that secondhand tobacco smoke in a closed car can expose a person to 3,000-4,000 micrograms of particulates per cubic meter.

Most wood stoves that warm cabin and home residents from coast-to-coast can’t meet that standard. Older stoves that don’t cannot be traded in for updated types, but instead must be rendered inoperable, destroyed, or recycled as scrap metal.
Does that make you angry?

It should.

There are other preppers that try to use very “clean” methods to power their homes, but that is still not good enough for some government control freaks.

For example, one prepper down in south Florida that had gone “off the grid” was recently ordered by a court to connect back to the grid or face eviction from his home. The following is an excerpt from a recent article by Guiles Hendrik…

Robin Speronis has lived off the grid, independent of the city’s water and electric system. A Florida court ruled this off-the-grid living illegal last week and has given Robin until March to connect her home to a municipal water line or face possible eviction. Further, officials in the city of Cape Coral have justified this by deeming Robin’s home “unsanitary,” citing the International Property Maintenance Code.

First of all, since when did we begin to locally recognize “international codes?” Where in the US Constitution does it provide for international jurisdiction over local codes? Ironically, this “international” code mandates that homes be connected to an electricity grid and a running water source, even though most of the world lives without reliable electricity and municipal water and sewer. Further, the code is outdated and obsolete because it was written without consideration to both old and new technologies that relegate the need for grid tied power and municipal water as unnecessary and expensive; especially, in locations where it simply isn’t feasible to have grid tied utilities.

Nonetheless, Speronis’ home does in fact have power and water through far cheaper and more environmentally friendly means — solar panels and rainwater, but that reality is ignored by the local government.

Incredibly, most Americans still seem to believe that we live in a “free country”. But we don’t. Our lives are very tightly constrained by literally millions of laws, rules and regulations, and more are being added every single day.

Even some of our most basic fundamental rights have been seriously eroded. One of these is the right to make basic health decisions for our own children. In New York state, children that have not received all of the designated vaccines can now be banned from attending public school, and this requirement was recently upheld by a federal appeals court…

New York state’s requirement that children be vaccinated before attending public school does not violate their constitutional rights, a federal appeals court in Manhattan said on Wednesday.

In affirming the requirement’s constitutionality, a three-judge panel of the 2nd U.S. Circuit Court of Appeals also upheld a previous ruling by a federal judge that students exempted from the requirement for religious reasons can be barred from school when another child has a disease preventable by a vaccine.

The decision was the latest to go against three parents from New York City who say their religious rights were violated when their children were kept out of school as a result of the immunization policies. The parents’ lawyer, Patricia Finn, said her clients planned to appeal to the U.S. Supreme Court.
So what are we free to do without government interference these days?

Not much.

In fact, in some states we can’t even sit on our own land and collect the rain as it falls from the sky for our own personal use.

If you do this in the state of Oregon, for example, you could go to prison…

Gary Harrington, the Oregon man convicted of collecting rainwater and snow runoff on his rural property surrendered Wednesday morning to begin serving his 30-day, jail sentence in Medford, Ore.

“I’m sacrificing my liberty so we can stand up as a country and stand for our liberty,” Harrington told a small crowd of people gathered outside of the Jackson County (Ore.) Jail.

And of course these are just a few examples. Almost every single day there are more stories in the news about government bureaucrats cracking down on preppers. They almost seem to relish the opportunity to go after the “non-conformists”.

But the good news is that the number of Americans that are seeking to become less dependent on the system just continues to grow.

The Washington Times published two news stories December 30 in which America’s Founding Fathers would have seen as a disturbing pattern.

The paper reported that the pace of military-grade shipments to police stations has accelerated in the wake of the Ferguson, Missouri riots and that Maryland State Police have been targeting out-of-state handgun owners on highways for technical violations of state gun control laws.

The Times noted that the federal Law Enforcement Support Office sent nearly 4,000 automatic weapons to local police agencies in just the last three months:

The 3,879 rifles the Pentagon shipped was an astronomical increase over the dozen rifles shipped during the same three-month period in 2013, with several police agencies taking delivery of hundreds of rifles soon after the Ferguson riots.

Armored vehicles, which drew particular scrutiny in the riots in Ferguson and other cities, were less popular in the aftermath. The Pentagon shipped just 11 mine-resistant vehicles, or MRAPs, from Aug. 15 through Nov. 14, compared to nearly 180 in the same time period a year earlier.

One of the recipients of the federal government largesse was the Michigan Department of Natural Resources, which received 415 M-16 automatic rifles, more than one for every one of their 256 officers. “They all work in pretty remote locations out of their homes, so that’s why they would each be outfitted with a rifle,” a spokesman for the Michigan DNR told the Washington Times, adding that the weapons would be able to fire only on semi-automatic once modified.

So much for the leftist slogan that one does not need an “assault weapon” to go hunting.

The concept of a militarized police force coupled with disarmed citizens flies in the face of the attitude of the Founding Fathers, who advocated the reverse: a disarmed government and a heavily armed citizenry. The 1780 Massachusetts state constitution, written by President John Adams, states in Article XVII:

The people have a right to keep and to bear arms for the common defence [sic]. And as, in time of peace, armies are dangerous to liberty, they ought not to be maintained without the consent of the legislature; and the military power shall always be held in an exact subordination to the civil authority, and be governed by it.

Meanwhile, the Maryland State Police have been targeting legal out-of-state gun owners for disarmament. “My wife’s hysterical, shaking and crying,” Florida resident John Filippidis told the Washington Times, after having his car searched on a speeding stop.

Filippidis noted that his family was made to stand out in the cold winter weather for 90 minutes, and police officers called him a “liar” for truthfully saying that his legal firearm was at his Florida home. Maryland’s strict citizen gun control laws don’t recognize out-of-state permits and have unnecessarily technical storage regulations almost guaranteeing out-of-state non-compliance. Filippidis stated,

I don’t have a criminal record. I own a business. I’m a family man, and I tried to explain that to [the officer]. But he had a bad attitude; didn’t want to hear my story. He just wanted to find that gun and take me away from my family. That was his goal, but he couldn’t do it, because I didn’t have a gun, like I told him.

A spokesman for the Maryland State Police didn’t deny targeting out-of-state concealed carry permit holders, and asserted that the procedure was perfectly legal.

The Maryland State Declaration of Rights, adopted in 1867, echoes the Massachusetts Constitution by strongly supporting a state citizen militia and calling a standing army “dangerous to liberty.”

Following the shooting that killed two New York police officers, the NYPD’s union has issued a statement announcing that in response, it has become a “wartime” police department.

As previously reported, Officers Wenjian Liu and Rafael Ramos were killed by Ismaaiyl Brinsley, after he ambushed and shot them both, in an alleged attempt to avenge the death of Eric Garner. Brinsley’s ambush of the two officers occurred shortly after he shot and wounded his ex-girlfriend in Baltimore, and then posted his plans to strike back at the police to her Instagram account.

According to the New York Post, Liu and Ramos were “working overtime as part of an anti-terrorism drill in Bedford-Stuyvesant,” when they were “shot point-blank in the head” by Brinsley.

Newsmax reported that the NYPD’s union, the New York Patrolmen’s Benevolent Association, issued a statement regarding the way the department is responding to this incident, and the way it is working to prevent future threats:

“Starting IMMEDIATELY: At least two units are to respond to EVERY call, no matter the condition or severity, no matter what type of job is pending, or what the opinion of the patrol supervisor happens to be.”

The statement went on to say that from this point forward, there would be no unnecessary arrests by New York police officers:

“IN ADDITION: Absolutely NO enforcement action in the form of arrests and or summonses is to be taken unless absolutely necessary and an individual MUST be placed under arrest.”

The statement noted that these precautions were ones that had been taken in the 1970s, when “police officers were ambushed and executed on a regular basis.”

The union concluded its statement by criticizing New York City Mayor Bill de Blasio, and blaming him for the fact that the NYPD has become a “wartime” police department:

“The mayor’s hands are literally dripping with our blood because of his words actions and policies and we have, for the first time in a number of years, become a ‘wartime’ police department. We will act accordingly.”

The FBI will hold active shooter training drills at sports stadiums as part of a massive program to prepare for what the agency says is a growing concern for law enforcement.

Thirty thousand agents will take part in the training sessions, which will also help prepare officers for active-shooter situations at businesses, schools and public places, according to the USA Today.

The FBI began developing the project after the 2012 mass shooting in Newtown, Conn., according to FBI deputy director Mark Giuliano.

Giuliano told USA Today that 200 FBI agents will help conduct the two-day training sessions, which will be held all around the U.S. and in Puerto Rico, making it the agency’s largest such effort.

With a completion date only 18 months down the road, newly-minted trainees are being thrust into instructor roles soon after completing their sessions.

Sports stadiums will be one focus of the program, as both operators and authorities worry the venues are a prime target for gunmen bent on achieving mass casualties.

“They have asked us for our assistance,” Giuliano told USA Today of sports venue operators. He did not specify which teams and which sports leagues have requested the help.

The FBI has partnered with Texas State University’s Advanced Law Enforcement Rapid Response Training Center on the program, with one goal being to shave mere seconds off police response times and threat identification and elimination.

“You have to stop the threat. That means urging first responding officers to move quickly toward the gunfire. That’s hard to do, even if you are a law enforcement officer,” Terry Nichols, the assistant director of Texas State’s rapid response training center, told USA Today.

Though the shooting at Newtown — where 26 children and teachers were killed at Sandy Hook elementary school — served as the catalyst for the program, the FBI found additional evidence to support the new training effort.

Reviewing shooting incidents from between 2000 and 2013, the agency found that mass shooting incidents went from 6.4 per year in the first half of the review to 16.4 in the second half, according to USA Today.

Though two-thirds the 160 incidents included in the FBI study came to an end before law enforcement arrived on the scene — either because the shooter committed suicide, fled, or was stopped by a citizen — Giuliano believes that the training will save at least some lives.

“I would say that even if we were able to respond (in time to confront the attacker) 20% of the time, this training would be worth it,” Giuliano told USA Today. “It’s really hard to say how many lives can be saved. But there is no question in my mind that when an officer engages, it makes a difference. No question.”
